This page sets out the licences that apply to the Open Electricity API, the Open Electricity Platform and the Energy Agent (together, the Service). It forms part of our Terms of Service.

Licensor: The Superpower Institute Limited (ABN 52 663 577 142, ACN 663 577 142) (Superpower Institute, we, us).

1. Standard licence (Community, Academic and Pro plans)

Data and content published through the Service are licensed under the Creative Commons Attribution-NonCommercial 4.0 International (CC BY-NC 4.0) licence.

You may share and adapt the material for non-commercial purposes, if you give appropriate attribution and indicate if you made changes.

This covers:

• data returned by the Open Electricity API and shown in the Platform
• responses, tables, charts and other outputs generated by the Energy Agent (Agent Outputs)

What counts as non-commercial

Non-commercial means not primarily intended for, or directed towards, commercial advantage or monetary compensation. Examples that are generally fine:

• personal projects and hobby use
• academic research and teaching
• journalism and public-interest reporting
• use by community groups and not-for-profit organisations, where not part of a paid service

Examples that are not covered by the standard licence:

• including the data or Agent Outputs in a product, service, app, report or dashboard that you sell, or that supports a paid product or service
• internal use by a for-profit organisation in the course of its business
• reselling, sub-licensing or redistributing the data, in bulk or through your own API
• training, fine-tuning, evaluating or grounding (including retrieval datasets) any AI or machine-learning model
• consulting or other paid work that uses the data

If you are unsure, contact us before relying on the standard licence.

Attribution

Include an attribution such as:

Data sourced from Open Electricity (The Superpower Institute), licensed under CC BY-NC 4.0.

For Agent Outputs, also state that the content was generated by an AI system and may contain errors.

2. Enterprise licence (commercial use)

Customers on the Enterprise plan receive an additional commercial licence. The terms in this section apply from the date your account is upgraded to Enterprise, unless you and Superpower Institute have signed a separate written agreement, in which case that agreement prevails to the extent of any inconsistency. By accepting an Enterprise upgrade, order form or quote that refers to this page, your organisation agrees to these terms.

Grant. For the term of your Enterprise subscription, Superpower Institute grants your organisation a non-exclusive, non-transferable, worldwide licence to use the data and Agent Outputs for commercial purposes, including:

• internal business use
• incorporation into your own products, services, reports and dashboards, including those you sell to customers
• training, fine-tuning, evaluating and grounding your own AI and machine-learning models

Conditions.

• Attribution to Open Electricity is required unless we agree otherwise in writing.
• You must not resell or sub-license the raw data as a standalone dataset, or offer a competing data API that substantially replicates the Open Electricity API.
• You may keep products and models built during the term, but your licence to receive new data ends when the subscription ends. Material you already incorporated into a product stays licensed for that product. You must stop using any retained copies of bulk data outside that product.
• The licence extends to your affiliates only if named in your order form.
• Use remains subject to the Terms of Service, including plan rate limits and acceptable use.

Service level. We aim to make the API available at least 99% of each calendar month, excluding planned maintenance, upstream outages (such as AEMO or other data providers) and events outside our reasonable control. This is a target, not a guarantee. We do not offer service credits unless set out in a signed agreement.

Zero data retention for the Energy Agent. Enterprise customers can ask us to switch off storage of Energy Agent prompts and responses. See the Privacy Policy.

Support. Priority email support.

Term and termination. The Enterprise licence lasts for the subscription term and ends when the subscription ends or is terminated under the Terms of Service.

3. Software licence

The Open Electricity SDKs and client libraries are open source and licensed under the MIT License. The software is provided "as is", without warranty of any kind, express or implied, and the authors are not liable for any claim, damages or other liability arising from its use. The MIT licence covers the software only. It does not license the data or Agent Outputs, which are governed by sections 1 and 2.

4. Incorporated data sources

Open Electricity data incorporates information from third-party sources, including:

• Australian Energy Market Operator (AEMO) — aemo.com.au
• Australian PV Institute (APVI) — apvi.org.au
• Bureau of Meteorology (BoM) — bom.gov.au

We process, clean, enrich and in some cases estimate this data. Third-party source data remains subject to the source's own terms. Nothing here transfers ownership of third-party data or grants rights greater than we hold.

5. Our trademarks

"Open Electricity" and our logos are not licensed under any licence above. You may use the name only to attribute the data as described in this page.

6. Warranty and liability

Data and Agent Outputs are provided "as is" and as available. We do not warrant that they are accurate, complete, current or fit for any purpose. The warranty and liability terms in the Terms of Service apply to all licences on this page.

7. Governing law

These licences are governed by the laws of Victoria, Australia, and are subject to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia, as set out in the Terms of Service.
