Terms of Service
Terms governing your use of the Open Electricity API, Platform and Energy Agent.
Last updated: 11 October 2026
These Terms of Service (Terms) are an agreement between you and The Superpower Institute Limited (ABN 52 663 577 142, ACN 663 577 142) (Superpower Institute, we, us). They govern your access to and use of the Open Electricity API, the Open Electricity Platform at platform.openelectricity.org.au and the Energy Agent (together, the Service).
By creating an account, ticking the acceptance box at sign-up, generating an API key or using the Service, you agree to these Terms, the Licence and the Privacy Policy. If you use the Service for an organisation, you confirm you have authority to bind it. If you do not agree, do not use the Service.
1. The Service
The Service provides programmatic and interactive access to Australian electricity and energy data, including generation, demand, emissions, prices and facility information. It includes:
- the API, accessed using API keys issued through the Platform
- the Platform, a developer portal for managing keys, usage, plans and support
- the Energy Agent, an AI assistant that answers questions about energy data and produces charts, tables and documents
2. Accounts and API keys
- You must provide accurate information and keep it up to date. You must be at least 18 years old.
- You are responsible for all activity under your account and API keys. Keep keys secret and do not share them or commit them to public code. Tell us promptly at [email protected] if you suspect a key has been compromised.
- One person per account. Do not create multiple accounts to get around plan limits.
- Academic plan eligibility depends on an accredited institution email address or other evidence we accept. We may move your account to another plan if you stop being eligible.
3. Plans and limits
Plans and their limits are as set out below and on the Plan page. We may change plans, limits, features and eligibility from time to time, and will give reasonable notice of material reductions to a plan you are on.
| Community | Academic | Pro | Enterprise | |
|---|---|---|---|---|
| Daily API credits | 500 | 2,000 | 5,000 | Unlimited (subject to fair use) |
| Burst rate | 2 requests/second | 2 requests/second | 5 requests/second | 10 requests/second |
| API keys | 1 | 5 | 10 | Unlimited |
| Licence | Non-commercial | Non-commercial | Non-commercial | Commercial |
The Pro plan is not publicly available. The Energy Agent is available to selected accounts and is subject to a per-user daily message cap, currently 50 messages per day.
Requests that exceed your limits may be throttled or rejected. Limits are enforced technically, and you must not attempt to evade them.
4. Licence to use data and Agent Outputs
Data and Agent Outputs are licensed to you under the Licence. In short:
- Community, Academic and Pro: Creative Commons Attribution-NonCommercial 4.0. Commercial use is not permitted.
- Enterprise: an additional commercial licence applies, as set out in the Licence or a signed agreement.
As a condition of access to the Service, and in addition to the Licence, you must not, unless you are on the Enterprise plan or we have agreed in writing:
- use the Service, data or Agent Outputs for commercial purposes
- use them to train, fine-tune, evaluate or ground any AI or machine-learning model
- resell, sub-license or redistribute them in bulk, or provide them through your own API
5. Acceptable use
You must not:
- break the law or infringe anyone's rights
- scrape, harvest or bulk-download data in ways that go beyond your plan limits, or circumvent rate limits, quotas or access controls
- probe, scan or test the vulnerability of the Service, or interfere with or disrupt it or its infrastructure
- use the Service to build a product that competes with it by replicating the API
- misrepresent Agent Outputs or data as official AEMO or government statements, or imply our endorsement
- use the Energy Agent to generate unlawful, harmful, deceptive or abusive content, attempt to extract its system prompts or jailbreak it, or use it for purposes unrelated to energy data or the Platform
- transmit malware or use the Service for spam
- use automated means to create accounts
6. Energy Agent
The Energy Agent is powered by third-party large language models and tools. By its nature it can produce output that is inaccurate, incomplete, outdated or misleading, including figures, charts, calculations and citations.
- No advice. Agent Outputs are general information only. They are not financial, investment, trading, legal, engineering, regulatory or other professional advice. Do not rely on them to make decisions without independently verifying them against primary sources.
- Verify. You are responsible for checking Agent Outputs before use, sharing or publishing. If you publish them you must include the attribution and AI disclosure required by the Licence.
- Your inputs. Do not enter personal, confidential, commercially sensitive or otherwise restricted information into the Energy Agent. Prompts, responses, tool calls and feedback are logged and retained, and are processed by third-party AI providers. See the Privacy Policy. Enterprise customers can request zero data retention.
- Sharing. If you create a public share link for a conversation or artifact, anyone with the link can view it until you revoke the link. You are responsible for what you share.
- Use of data for improvement. We may use logged prompts and responses and your feedback to operate, secure, evaluate and improve the Service, as described in the Privacy Policy.
- Availability. We may limit, change or withdraw the Energy Agent at any time.
7. Data accuracy
Our data is compiled from third-party sources including AEMO, APVI and the Bureau of Meteorology, and we may clean, estimate, impute or re-aggregate it. Data can be delayed, revised, missing or wrong. We do not guarantee its accuracy, completeness or timeliness. It is not suitable for use in safety-critical, trading or settlement decisions.
8. Intellectual property
As between you and us, we and our licensors own the Service, including the Platform, API, Energy Agent, our trademarks and the databases we compile. Except for the licences expressly granted, we reserve all rights. You own your inputs and, subject to the Licence, you may use the outputs made from them under the Licence.
You grant us a non-exclusive, worldwide licence to host, process and use the content you submit (including support tickets, prompts and feedback) to provide, secure and improve the Service.
If you give us feedback or suggestions, we may use them without restriction or obligation to you.
9. Availability and changes
The Service is provided without any service level commitment. We will try to keep it available but it may be unavailable, interrupted, slow or changed at any time, including for maintenance or because of upstream providers. Enterprise customers may have a service level target as set out in the Licence.
We may change, suspend or discontinue any part of the Service. We will try to give reasonable notice of material changes, other than urgent or security-related ones.
10. Suspension and termination
We may, at our sole discretion and without liability, suspend, block, restrict or terminate your account, revoke API keys or limit access at any time, with or without notice, including if we reasonably believe you have breached these Terms or the Licence, abused the Service, or put it or others at risk, or if required by law.
You may stop using the Service and close your account at any time through the Platform or by emailing [email protected].
On termination your licence to use the Service ends, API keys stop working, and we may delete your account data subject to our Privacy Policy and legal obligations. Sections that by their nature should survive (including sections 4, 6 to 8, 11 to 13 and 15) survive termination.
11. Warranties and Australian Consumer Law
The Service, data and Agent Outputs are provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties, conditions and guarantees, whether express, implied, statutory or otherwise, including as to accuracy, merchantability, fitness for a particular purpose, availability, non-infringement and that the Service will be uninterrupted or error-free.
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded (Non-excludable Rights). If you are a consumer under the Australian Consumer Law, you may have rights that cannot be excluded.
To the extent that we are permitted by law to limit our liability for breach of a Non-excludable Right, our liability is limited, at our option, to resupplying the Service or paying the cost of having it resupplied.
12. Limitation of liability
To the maximum extent permitted by law, and subject to section 11:
- we are not liable for any indirect, incidental, special or consequential loss or damage, or any loss of profit, revenue, business, goodwill, data or anticipated savings, or for any loss arising from your reliance on data or Agent Outputs, arising out of or in connection with the Service or these Terms, whether in contract, tort (including negligence), statute or otherwise, even if we were advised it might occur
- our total aggregate liability to you arising out of or in connection with the Service or these Terms is limited to the greater of (a) the fees you paid us for the Service in the 12 months before the event giving rise to the claim and (b) AUD 100
Our licensors and the providers of source data (including AEMO, APVI and the Bureau of Meteorology) have no liability to you in connection with the Service.
13. Indemnity
You indemnify us and our directors, officers, employees and contractors against any loss, liability, claim or expense (including reasonable legal costs) arising from your breach of these Terms or the Licence, your misuse of the Service, or your publication or use of data or Agent Outputs, except to the extent caused by our own breach or negligence.
14. Privacy
Our Privacy Policy explains how we handle personal information.
15. General
- Governing law. These Terms are governed by the laws of Victoria, Australia. Each party submits to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia sitting in Victoria.
- Changes. We may update these Terms. We will post the updated version with a new date and, for material changes, notify you by email or in the Platform. If you continue to use the Service after the effective date, you accept the update.
- Entire agreement. These Terms, the Licence and the Privacy Policy are the entire agreement between us about the Service. A signed Enterprise agreement prevails over them to the extent of any inconsistency.
- Assignment. You may not assign your rights without our written consent. We may assign ours to a successor or related entity.
- Severability and waiver. If a provision is unenforceable, the rest continues in effect. A failure to enforce a right is not a waiver.
- Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control, including upstream data or infrastructure outages.
- Notices. We may give notice by email to your account address or through the Platform. Send legal notices to [email protected].
